I agree with you, but it's important not to be overly concerned about vocabulary. Companies often negotiate and say that they compromised even though actually one party got everything it wanted. In other words, what matters is if he's agreeing to any kind of restrictive terms, and not what you call the process.
Fuck Disney. But if Disney can somehow find the decency or practical motivation to use their lawyers to fight back against the US government, they have a very good chance of winning on this specific issue. And that's something I would love to see.
